For what purposes do we process your personal data?

We process the personal data of emarketindustry users for the following purposes:

• Managing your orders.

• Addressing the requests or inquiries made to us.

• Conducting statistical studies to help us improve the services we provide.

• If you have not purchased any product offered by emarketindustry yet, but you give us your consent, we may also process your data to send you marketing information about our activities, products and services

• If you have already purchased any of the products offered by emarketindustry, according to article 21.2 of the Law 34/2002 on E-Commerce and Information Society Services, we are allowed to send you marketing communications by electronic means regarding our products or services that are similar to the ones you have purchased, although you have the right to oppose to this type of mailings at any time, which you can do by checking the corresponding box in the purchase process or by communicating it to us later via e-mail at sales@emarketindustry.com

What is the legal basis for the processing of your data?

The legal basis for processing the data for the purposes set forth in the paragraph above is as follows:

• Managing User orders - Legal basis: execution of the service contract.

• Addressing the requests or inquiries made to us - Legal basis: execution of the service contract or consent in the case of inquiries made by interested parties who are not registered with emarketindustry.

• Conducting statistical studies - Legal basis: emarketindustry's genuine interest to improve our services.

• Send commercial information - Legal basis: consent of the interested party or the existing contractual relationship with the interested party, in case they have not refused to receive commercial communications.

To which recipients will your data be communicated?

The data will be communicated to the sellers to whom the User places an Order through emarketindustry given that it is a necessary communication to process the order. Except in cases where it is necessary to communicate the data to process orders, the data will not be communicated to third parties, unless required by law.

The first and last name, phone and e-mail are mandatory data so that a User can place an Order, on behalf of a company, if not provided, the User will not be able to register in emarketindustry and make use of its services. The mailing address is required for delivery of orders.

The data is limited, since we only process the data we need for the provision of our services.

How did we obtain your data?

The personal data we process is provided by the interested party. The interested party guarantees that the personal data provided are true and is responsible for communicating any changes to them. Fields marked with an asterisk are mandatory in order to provide you with the requested service.

How long will we keep your data?

The personal identification and contact data will be kept as long as the User does not unsubscribe from emarketindustry or does not wish to receive information, given that Users may object to the processing of their data for commercial purposes at any time, and thereafter, for the minimum term established to comply with our legal obligations, which in the case of accounting and fiscal documentation for commercial purposes will be 6 years, in accordance with Art. 30 of the Commercial Code; and for tax purposes will be 4 years, in accordance with Articles 66 to 70 of the General Tax Law.

What are your rights when you provide us with your data?

• Any person has the right to obtain confirmation as to whether or not we are processing their personal data.

• Interested parties have the right to access their personal data, as well as to request the rectification of inaccurate data or, if necessary, request their elimination when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

• Under certain circumstances the interested parties may request the limitation of the processing of their data, in this case we will only keep them for the exercise or defense from any claims.

• Also, under certain circumstances and for reasons related to their particular situation, interested parties may object to the processing of their data. In this case we will no longer process the data, except for compelling legitimate reasons or for the exercise or defense from any possible claims.

• Interested parties also have the right to data portability.

• Every person shall have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects upon them or that significantly affects them in a similar way.
